* Does not control decisions made by Immigration, Refugees and Citizenship Canada (IRCC), Employment and Social Development Canada (ESDC), or other governmental authorities.
* Provides services based on information supplied by the client.
Nothing in this Agreement shall be interpreted as a guarantee of outcome.
3. NO LEGAL ADVICE
Unless expressly stated in a separate written retainer agreement with a licensed attorney, LMIA EXPRESS INC. does not provide legal advice.
All information provided by the Company is for general informational purposes only and should not be relied upon as legal advice. Clients are encouraged to consult a licensed lawyer for legal interpretation and advice.
4. CLIENT RESPONSIBILITIES
By engaging our services, you agree to:
* Provide complete, accurate, and truthful information.
* Promptly notify the Company of any changes to submitted information.
* Review all documents prepared on your behalf before submission.
* Pay all fees in accordance with the agreed payment terms.
The Company shall not be liable for delays, refusals, penalties, or adverse decisions resulting from inaccurate or incomplete information provided by the client.
5. FEES AND PAYMENT
Fees for services will be set out in a separate written agreement, invoice, or service contract.
Unless otherwise agreed:
* Fees are due as specified in the invoice.
* Government filing fees are separate and are the client’s responsibility.
* Fees paid may be non-refundable once services have commenced, except as required by law.
Failure to make timely payment may result in suspension or termination of services.
6. REFUNDS
Refund policies shall be governed by the specific service agreement signed between the parties.
Unless expressly stated in writing:
* No refunds are provided for work already performed.
* No refunds are provided for government refusals or processing delays.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law:
* The Company shall not be liable for indirect, incidental, special, consequential, or punitive damages.
* Total liability arising from any claim shall not exceed the total service fees paid by the client for the specific service giving rise to the claim.
The Company shall not be liable for delays, policy changes, or decisions made by governmental authorities.
8. INDEMNIFICATION
You agree to indemnify and hold harmless LMIA EXPRESS INC., its directors, officers, employees, contractors, and agents from any claims, damages, losses, or expenses arising from:
* Your breach of this Agreement;
* Your provision of false or misleading information;
* Your misuse of our services.
9. CONFIDENTIALITY
The Company will maintain confidentiality of client information in accordance with its Privacy Policy and applicable law.
However, information may be disclosed where required by law or governmental authority.
10. INTELLECTUAL PROPERTY
All website content, branding, materials, templates, and documentation created by LMIA EXPRESS INC. remain the intellectual property of the Company unless otherwise agreed in writing.
Clients are granted a limited, non-transferable license to use documents prepared for their specific application purposes only.
11. TERMINATION
Either party may terminate services in writing.
Upon termination:
* The client remains responsible for payment of services rendered.
* The Company may retain documents until outstanding fees are paid, where permitted by law.
12. WEBSITE USE
You agree not to:
* Use the website for unlawful purposes;
* Attempt unauthorized access to systems;
* Disrupt website functionality.
The Company reserves the right to restrict or terminate website access at its discretion.
13. FORCE MAJEURE
The Company shall not be liable for delays or failure to perform resulting from events beyond its reasonable control, including but not limited to governmental actions, policy changes, system outages, or natural disasters.
14. GOVERNING LAW
